MUST READ | Shaykh al-Albaani Rahimahullaah refuting the doubts of those who say PHOTO-TAKING is not haraam!

Among the scholars who have discussed the issue of photography is Shaykh Naasir al-Deen al-Albaani, who said:

“Some of them differentiate between hand-drawn pictures and photographic images by claiming that the latter are not products of human effort, and that no more is involved than the mere capturing of the image. This is what they claim. The tremendous energy invested the one who invented this machine that can do in few seconds what otherwise could not be done in hours does not count as human effort, according to these people! Pointing the camera, focusing it, and taking the picture, preceded by installation of the film and followed by developing and whatever else that I may not know about… none of this is the result of human effort, according to them!

Some of them explain how this photography is done, and summarize that no less than eleven different actions are involved in the making of a picture. In spite of all this, they say that this picture is not the result of human action! Can it be permissible to hang up a picture of a man, for example, if it is produced by photography, but not if it is drawn by hand?

Those who say that photography is permitted have “frozen” the meaning of the word “tasweer,” restriciting it only to the meaning known at the time of the Prophet (peace and blessings of Allaah be upon him) and not adding the meaning of photography, which is “tasweer” or “picture-making” in every sense – linguistic, legal, and in its harmful effects, and as is clear from the definition mentioned above. Years ago, I said to one of them, By the same token, you could allow idols which have not been carved but have been made by pressing a button on some machine that turns out idols by the dozen. What do you say to that?”

Compilation of most of the proofs that Photo-Taking is Haraam.-

1- Hadeeths From The Prophet sallalaahu ‘alayhi wa sallam himself:

“The head is what makes something an image. So if the head is cut off, then there is no (forbidden) image.”

Hadeeth Number #3864 of Saheeh al-Jaami as-Sagheer wa Ziyaadatuh’

Abu Hurairah (may Allah be pleased with him) reported that the Prophet (peace and blessings of Allah be upon him) said: “Allah, may He be exalted, says: ‘Who does more wrong than the one who tries to create something like My creation? Let him create a grain of wheat or a kernel of corn.'” (Reported by al-Bukhari, see Fath al-Baari, 10/385).

“On the Day of Resurrection a neck will stretch forth from Hell; it will have two eyes to see, two ears to hear, and a tongue to speak. It will say, “I have been appointed to take care of three types of people: every arrogant tyrant, every person who called on some deity other than Allaah (swt) and those who made pictures”

[at-Tirmidhi stated that this hadith was saheeh – at-Takhweef min an-Naar, p.179, See also Jaami’ al-Usool, 10/518, the editor said its isnaad is hasan]

‘Ali (may Allah be pleased with him) said: “Shall I not send you on the same mission as the Messenger of Allah (peace and blessings of Allah be upon him) sent me? Do not leave any built-up tomb without leveling it, and do not leave any picture in any house without erasing it.” (Reported by Muslim and al-Nisaa’i; this is the version narrated by al-Nisaa’i).

Ibn ‘Abbaas (may Allah be pleased with him and his father) reported that the Prophet (peace and blessings of Allah be upon him) said: “Every image-maker will be in the Fire, and for every image that he made a soul will be created for him, which will be punished in the Fire.” Ibn ‘Abbaas said: “If you must do that, make pictures of trees and other inanimate objects.” (Reported by Muslim, 3/1871)

Narrated Abdullaah ibn ‘Umar (d.73H) radiallaahu ‘anhu: Allaah’s Messenger sallaahu ‘alayhi wa sallam said, “Those who make these images (suwar) will be punished on the Day of Resurrection, and it will be said to them, make alive what you have created.” (Al-Bukhaaree 7/541, no.835; Muslim, 3/160, no.,5268)

2- Shaykh Muhammad Naasirud-Deen al-Albaanee Rahimahullaah (May Allaah have mercy on him)

al-Albani: There is no difference between picture-making with a pen and picture-making with a camera. (AFI 7, afatwa.com)

al-Albânî said: “I fear that Salafiyyûn one day will say: ‘Photography isn’t ‘picture making’. You just press a button.’.” (Silsilat-ul-Hudâ wan-Nûr 393)

3- Shaykh Muhammad Saalih al-‘Uthaymeen Rahimahullaah (May Allaah have mercy on him)

Ibn ‘Uthaymin: It is forbidden to photograph if the purpose is to have the picture as a memory. (LBM 76, afatwa.com)

Shaykh Ibn Uthaymeen clarifies his ruling on pictures

Question: To the noble Shaykh Muhammed Ibn Salih Al-Uthaimin, may peace be upon you, and the mercy and the blessing of Allah.We nowadays see many pictures, large and small, in stores and supermarkets. They are pictures of famous people,pictures that are placesd on products to give prestige to those products. When we warned store owners about thisbeing unlawful, they said that these pictures are not three-dimensional and that they do not cast a shadow, andtherefore they are not unlawful. They say that they read a ruling of yours in ‘Al-Muslimun magazine, a ruling that statesthat three-dimensional picture, or something that has a body, is unlawful, but otherwise it is not. Please clarify this issuefor us. May Allah reward you well and may peace and Allah’s mercy and blessing be upon you.

Answer: In the name of Allah, the Most Beneficent, the Most Merciful, and upon you peace and Allah’s mercy and blessings.Whoever attributes to me the saying that pictures that has a body is unlawful, but other than that is not unlawful,has lied upon me. I hold the view that it is not not allowed to have any pictures, regardless whether it is a picture onclothes for adults or for children. All pictures, including those kept as memento, are not allowed unless there is anecessity for having or taking one.

Question: What is the ruling on taking photographs, when they are for necessity and when they are for adornment?

Answer: Pictures of living (humans and animals) are unlawful except for necessity. Examples of necessity include identity photos, passport photos, or photos of criminals for the purpose of identification and then arrest when they commit a crime or attempt to flee.

4- Shaykh ‘Abdul-‘azeez ibn Baaz Rahimahullaah (May Allaah have mercy on him)

When I go out on excursions with a group of friends, I take pictures to keep them as mementos. What is the ruling on taking pictures for this purpose?

Answer: The ruling is this practice is that it is unlawful, that is, if the picture is taken of something with a sole (a human or an animal), The Prophet (sallallaahu alaihi wa sallam) said: The people who will be most severely punished on the Day of Judgement will be the picture-makers. [1] The Prophet (sallallaahu alaihi wa sallam) also cursed those who make pictures. As for taking pictures of things without a soul – a car, a plane, a tree, etc., – there is no harm in that. And with Allaah is the facilitation to do what is right.

5- Shaykh ‘Ubayd al-Jaabiree Hafidhahullaah (May Allaah preserve him)

Question:

Is it permissible to look at a picture of a woman before marriage?

Answer:

Pictures are forbidden. Pictures that contain souls are not permissible and what occurs from the Muslims today is that the male fiance and his intended (spouse) exchange photographs with one another. Then this is blind following of the West.

So he should see her in person, by way of her walee (guardian), if he desires to be engaged (to her). Only, then can he look at her and she can look at him. Yes.

Shaykh ´Ubayd bin ´Abdillâh al-Jâbirî:
I say that the pictures of souls are haram and it is from the kabaa’ir (the major sins).

The Messenger, [salla Allaahu ‘alayhi wa sallam], said:

“The people who will be most severely punished on the Day of Judgement will be the image-makers.”And he, [salla Allaahu ‘alayhi wa sallam], also stated that

the image maker will be presented with an image and it will say ‘Blow a spirit therein, which he will not be able to do’.

And from this we know that

it is not permissible to publish pictures (images) of people in Twitter or other networks. When the agency responsible (for the networks) request a picture for a specific matter such as licences (for traffic) and security (passports etc) and other authority bodies that employs a person, then it becomes necessary or in need of. And it cannot exceed further than this.

Taking Pictures Using A Mobile Phone

Question:What is the ruling concerning taking pictures using a mobile phone considering some people say that it is just capturing a shadow and there is no prohibition in that, so what is the ruling concerning that?

Answer:For HIM there is no prohibition in that, as for the Sunnah and the evidences then picture taking/making in general is Haraam (prohibited) and the picture maker is cursed. And he will receive from the most severest of punishments on the Day of Judgment.So what is it that takes the mobile phone out from this generality? The Messenger made picture making Haraam without exception by any means; (whether that be by way of ) a mobile phone, a camera, by hand(sculpting) or by drawing, he made it absolutely Haraam. So who is he that makes an exception from what the messenger sallallaahu alaihi wasallam said and attempts to redress the messenger. Apart from that the Muhaqqiqeen (verifiers) from the Scholars make an exception in the case of necessity, if a person is in need of taking a picture for a necessity then it is allowed due to this necessity due to His saying – the Most High:While He has explained to you in detail what is forbidden to you, except under compulsion of necessity? [Surah al-‘An’aam:119] As for picture taking as a hobby or as a form of art by the use of the camera or by hand or by any object then it is Haraam and it is not allowed except in case of necessity only. In accordance to the necessity it is a concession. It is a concession due to a necessity only.

Shaykh Muhammad bin Hādī Al-Madkhalī:

“My position on this is well known, and the speech of the scholars about this is well-known. It is not permissible except where necessity calls for it. So if there is a necessity such as a license, card, a situation, passport or any official documentation where work depends on or matters relating to your life depend on there is no problem in that because necessity makes the forbidden permissible. The origin for this is His – جلا وعلا‏ – statement: “[…] He has explained to you in detail what is forbidden to you, except under compulsion of necessity.” [Al-An’am 6:119]. So if there is a necessity then there is no problem, but apart from that, then no.”

Q 3: Does the curse upon photographers include photographed people? Is there any specific evidence that denotes the curse upon photographed people?

A: There are reported pieces of evidence that denote the curse of the photographers and the threat of hellfire in the Hereafter. This also applies to those who permit themselves to be photographed. Allah (Exalted be He) says: And it has already been revealed to you in the Book (this Qur’ân) that when you hear the Verses of Allâh being denied and mocked at, then sit not with them, until they engage in a talk other than that; (but if you stayed with them) certainly in that case you would be like them. Allah (Exalted be He) says with regard to the story of Thamud: Thamûd (people) denied (their Prophet) through their transgression (by rejecting the true Faith of Islâmic Monotheism, and by following polytheism, and by committing every kind of sin).When the most wicked man among them went forth (to kill the she-camel).But the Messenger of Allâh [Sâlih عليه السلام] said to them: “Be cautious! (Fear the evil end). That is the she-camel of Allâh! (Do not harm it) and bar it not from having its drink!”Then they denied him and they killed it. So their Lord destroyed them because of their sin, and made them equal in destruction (i.e. all grades of people, rich and poor, strong and weak, etc.)!And He (Allâh) feared not the consequences thereof. `Abdul-Wahid ibn Zayd said: “I asked Al-Hasan: ‘O Abu Sa`id, what about a person who did not witness the disorder of Abu Al-Muhallab, but he was satisfied with that.’ He said: ‘My dear! How many persons participated in killing the she-camel (of Thamud)?’ I said: ‘One person’.He said: ‘Did not Allah destroy the whole community because of theircontent and encouragement of this person?'” (Related by Imam Ahmad in his book Al-Zuhd). These two verses denote that a person who approves of something is like the person who does it.(Part No. 1; Page No. 679)
This ruling does not apply to a person who was obliged to be photographed.

Q 3: A debate arose between some brothers on photography and keeping photographs and the conclusion is still determined. So what is the ruling on photography and keeping photographs?

A: Taking photographs of living beings, be they humans or animals, and keeping these photos, is unlawful. In fact, it is one of the major sins, for there are authentically reported Hadiths about the terrible threat and severe torment that will befall photographers and those who keep photographs, also because taking photographs is similar to imitating Allah in creating living beings and may be a means to Shirk (associating others with Allah in His Divinity or worship) like honoring the photographs of great figures and righteous people, or a means for temptation like photographs of beautiful women, actors, actresses, and semi-naked women.
